Abusive conduct
Giving false information to obtain access to the Company's system and/or purchase and/or utilize any service. Engaging in any illegal, criminal or malicious activities. Any other activity or activities that Cowichan Valley Bottle Depots Ltd., in its sole discretion determines is unethical or damaging to our other customers, users of the Internet, Cowichan Valley Bottle Depots Ltd.’s Network or to our corporate reputation. Cowichan Valley Bottle Depots Ltd.’s Commitment to Privacy Policy;
Protecting privacy, and in particular that of the schools and children involved in student fund raising programs, is a fundamental tenet of Cowichan Valley Bottle Depots Ltd. and its affiliated companies, who are committed to maintaining the confidentiality and security of customer information, and that of the individuals or groups who access our Web site. Information collected;
The supervisor or event coordinator for the fund-raising committee (IE: bottle drive) of your child's school or community group will have the ability through a password-protected area on our Web site to download his or her name, as well as a list of alternate contact names that may contain that of students. These alternates may contain the child's first and last name, and other personal information such as their e-mail address, and telephone number. This information should be provided only where it is necessary for Cowichan Valley Bottle Depots Ltd. to completing the services you request, and you will not be able to use such services without providing this information. Use of Information;
We use this information to provide you with tips and other information on how best to organize and complete the fund raising event (IE: bottle drives and other direct school/community donations programs) at your school or other community function. Anonymous and non-personal information, which cannot be identified with a specific individual or group may be used for research and analytical purposes only within the Cowichan Valley Bottle Depots Ltd.’s Group of Companies. However, Cowichan Valley Bottle depots Ltd. will not collect, create, disclose or share the information collected from you or aggregate anonymous statistics regarding our customers, sales, traffic analyses and other information regarding or collected through our Web site with any third party unless required to do so by law or legal process.
We are keenly aware of the legitimate concerns surrounding privacy and security of customer information entrusted to us. h) Customers shall, at all times, have full access to their information and may verify the completeness of the customer information, and may make amendments as required,
i) All employees with access to our Web-site data base, as a condition of employment, are required to abide by Cowichan Valley Bottle Depots Ltd.’s Privacy Policy, to be acknowledged at the time of employment under a employee code of conduct agreement, and periodically thereafter.
j) Outside service providers (IE; banks, data processing, credit card processing etc. ) are carefully screened in advance and are provided with only the information required to complete the service they have been contracted to do. Promotional Contests and Advertising
Introduction
Cowichan Valley Bottle Depots Ltd. does, on occasion, awards prizes or other gifts in support of the local arts community, various local and provincial charities, and local sports organizations. In undertaking any such promotional and other contest(s), lottery, game of chance or skill, or mixed chance and skill, or otherwise disposes of any product or other benefit by any mode of chance whatever for the purpose of promoting, directly or indirectly, the supply or use of a product or service, or for the purpose of promoting, directly or indirectly, any business interest, Cowichan Valley Bottle Depots Ltd. will comply with all regulations as set out by the Commissioner of Competition in enforcing the Competition Act, and, where applicable, those sections of the Criminal Code, provincially and federally.
Competitions Act:
In particular, Section 74.06 of the Competitions Act requires fair and adequate disclosure of;
a) the number of prizes,
b) the approximate “regular market “ value of prize(s) . In instances where it is difficult to make such an approximation, the value of the prize(s) will include a few representative examples or of the range of possible values of the prize(s),
c) the geographical area or areas to which they relate. In those circumstances where prizes are allocated on a regional basis (IE: one for entrants from Duncan B.C., one from Campbell River B.C.), while the promotion for the contest takes place on a wider geographical basis, any regional allocation of prizes will be clearly disclosed.
d) any important information relating to the chances of winning, such as the odds of winning. (IE: whenever the total number of seeded prizes in any production run or other population is known, or where multiple tokens are needed to win, or where the total number of entrants in any geographical area is restricted, this matter would be a "fact within the knowledge of the advertiser that affects materially the chances of winning", and will therefore be disclosed,
e) when a contest involves a series of prizes to be awarded at different times, care should be taken to ensure that the promotional material does not imply that prizes remain to be won when they have, in fact, already been awarded. For example, in a contest where a prize of $1,000 is to be awarded each month for a series of five months, advertisements for the contest should not continue to imply, after the first month of the contest, that five $1,000 prizes are to be awarded.
f) where "early bird" prizes are to be awarded only to the first entrants in a contest, Cowichan Valley Bottle Depots Ltd. will disclose the starting date for the contest and the last date on which early bird prizes will be awarded
g) where Cowichan Valley Bottle Depots Ltd. holds a promotional contest involving specially-marked packages of its product, the Company will ensure that proper disclosure of the contest rules is made wherever the specially-marked packages are available, or provide a short list of the contest rules on the outside of each package/entry form. The consumer will not have to buy the product or tamper with it to read these rules. This short list will, in addition to the above, contain the skill testing question, if any.
The Competitions Act further stipulates that;
a) the distribution of prizes cannot be unduly delayed and that participants be selected or prizes distributed on the basis of skill or on a random basis.
b) disclosure(s) will be made in a reasonably conspicuous manner prior to the potential entrant being inconvenienced in some way or committed to the advertiser's product/service or to the contest. Therefore, the onus to provide "fair and adequate disclosure" is on Cowichan Valley Bottle Depots Ltd. and not the consumers to obtain further details that, by statute, are required to be disclosed by the advertiser, and
c) a contest advertised in the media should not require that a consumer visit or patronize any particular retail outlet of the Company, or one of its affiliated companies, in order to become adequately and fairly informed of the information required by the provision.
Advertising:
Furthermore, in order to meet the requirements of “adequate and fair” advertising, as outlined by the Department of Consumer and Corporate Affairs Canada in its Guidelines on Misleading Advertising, appropriate disclosure listing the required information will be made in a reasonably conspicuous manner at a time before the potential entrant is inconvenienced in some way or committed to purchase product and/or services or to the contest.
Criminal Code;
In addition to complying with section 74.06 of the Competition Act, all contests conducted by Cowichan Valley Bottle Depots Ltd. will be lawful as it relates to other federal statutes such as the Criminal Code, as well as any relevant provincial statutes and local by-laws. The most relevant law dealing with lotteries, games of chance and games of chance is Section 206 of the Criminal Code, and in particular as it deals along with the requirements of Section 74.06 of the Competition Act. Specifically thereunder, it is an indictable offence to disposes of any goods, wares, merchandise or services by any game of chance or any game of mixed chance and skill in which the contestant or competitor pays money or other valuable consideration. In effect this section prohibits a requirement that a product or service be purchased as the sole condition of contest participation. Therefore, Cowichan Valley Bottle Depots Ltd. will, as a prudent promoter, continue to provide a free-entry alternative to more confidently avoid section 260(1)(f) through entry forms made available on its Web site and/or "reasonable hand-drawn facsimile" etc. and where participation is not restricted to individuals making a purchase or using the services of Cowichan Valley Bottle Depots Ltd. As such, illegal contests under paragraph 206(1)(f) are avoided since one of the three requirements of an illegal contest (1. prizes, 2. chance, and 3. consideration), the purchase requirement, has been removed.
Note:
Unlike the Criminal Code, section 74.06 of the Competitions Act does not directly prohibit a requirement that participants pay money or other valuable consideration in order to participate in a contest. Therefore, alternatively, where a purchase is necessary in order to participate (IE: in a contest of pure skill such as a slogan-writing competition), this fact will be prominently disclosed in order to avoid giving the Commissioner reason to initiate an inquiry.1
Where no purchase is required, this fact will also be prominently disclosed in situations where failing to do so could lead those wishing to participate to make a purchase or use the services of Cowichan Valley Bottle Depots Ltd. due to a mistaken belief that a purchase or use of services is necessary in order to participate or, alternatively, in situations where they might be discouraged from entering, thus materially affecting participants' chances of winning.
